TERMS OF USE — StudyHackz

These Terms of Use (the "Terms") are a binding agreement between Study Tools LLC, a New Mexico limited liability company, d/b/a "StudyHackz" ("StudyHackz," "we," "us," or "our") and the person or entity that creates an account, installs our extension or app, or uses our websites and services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. What StudyHackz is and is not
StudyHackz provides notifications and study-workflow tools. We do not answer questions for you, change your location, bypass attendance, or automate submissions. We are not affiliated with or endorsed by any educational institution, college, university, high school, Macmillan Learning, iClicker®, Canvas™, or any third-party platform. Names of third-party services are used only to identify compatibility and all trademarks belong to their owners.
2. Eligibility and account
You must be at least 18 years old or the age of majority where you live and able to enter a contract. Keep your credentials secure. You are responsible for activity under your account.
3. Acceptable use
You agree you will not:
- (a) use the Service to cheat, gain credit without attendance, evade proctoring, or violate any course, campus, or platform policy;
- (b) scrape, crawl, spider, or otherwise automate access to third-party services in violation of those services’ terms;
- (c) attempt to bypass geoblocks or institutional restrictions;
- (d) reverse engineer or interfere with security of the Service.
4. Institutional blocks
We may block or disable use for specific institutions, courses, or regions. If a block is triggered, the Service will not function. You must not attempt to circumvent any block.
5. Subscriptions and billing
Prices and plan terms are shown at checkout. Unless stated otherwise, subscriptions renew automatically until you cancel. Except where required by law, fees are non-refundable. Taxes may apply. Payments are processed by Stripe. We do not store full card numbers.
6. Notifications and SMS
If you enable email, push, or SMS notifications, you consent to receive such messages. Message and data rates may apply. You can opt out in settings or by replying STOP for SMS.
7. Third-party services
The Service may interoperate with third-party platforms. Those platforms are governed by their own terms and privacy policies. We are not responsible for them.
8. Intellectual property
We own the Service and associated intellectual property. You receive a limited, revocable, non-transferable license to use the Service as permitted by these Terms. You may not copy, modify, reverse engineer, or create derivative works of the Service.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your account immediately for suspected violations or unlawful use. Sections that by their nature should survive termination will survive.
10. Unaffiliated notice
iClicker® and other referenced names are trademarks of their respective owners. StudyHackz is not affiliated with or endorsed by Macmillan Learning, iClicker®, Canvas™, or any educational institution, college, university, or high school.
11. No warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND ACCURACY. WE DO NOT GUARANTEE DELIVERY OR TIMELINESS OF NOTIFICATIONS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDYHACKZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT.
13. Academic responsibility and institutional consequences
You are solely responsible for your use of the Service and for complying with all academic policies and applicable laws. StudyHackz is not responsible for and disclaims any liability related to your grades, academic-integrity findings, disciplinary actions including probation, suspension, expulsion, loss of credit, program or visa consequences, or any other sanctions or penalties imposed by any institution or authority.
14. Indemnification
You agree to defend, indemnify, and hold harmless StudyHackz from any claim, damage, liability, cost, and expense, including reasonable attorneys’ fees, arising out of your use of the Service in violation of academic policies or third-party terms, your attempts to bypass blocks or add automation, or your breach of these Terms.
15. Changes to the Terms
We may update these Terms. Material changes will be presented in-app for re-acceptance before you continue.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute will be resolved by binding arbitration on an individual basis. Where arbitration is not permitted, exclusive venue lies in the state or federal courts located in Bernalillo County, New Mexico, and you consent to jurisdiction there.
